Gerekçe; Madde İsviçre Medenî Kanununun 233 üncü maddesinden aynen alınmıştır. Yürürlükteki Kanuna göre, mal ortaklığı rejiminde, evlilik birliği için yapılan borçlardan ilke olarak koca, şahsen ve ortaklık mallarıyla sorumludur. Eşlerin eşitliği ilkesinden hareketle sevkedilen bu hükümle, evlilik birliğinin borçlarından dolayı eşler eşit bir şekilde sorumlu tutulmuştur. Either of spouses, is liable from following debts with his or her personal and community properties; 1. From debts incurred pursuant to power of representation of union of marriage or administration of properties of community, 2. From debts incurred because of performing of a profession or craft by being used properties of community or incomes which are included in properties of community, 3. From debts which create personal liability for the other spouse too, 4. From debts incurred by spouses by agreeing with third parties that there would be liable properties of community beside personal property.
