Common property regulation
Situation: I am a Norwegian citizen having purchased a house near Bodrum. The house is in a compound (total 3600 squaremeters) having a total of 13 units. Each unit consists of a house with a small garden around (property area 220 sqm), and is an exclusivly owned property. On the compound area are also common property, consisting of a pool area, stairs and stairways, and some small pieces of garden. In our contract, there are no regulations as to garden keeping, neither for the common property or the exclusivly owned property.
Of the 13 units, 8 are sold, and 5 are still unsold. The constructor has hired two of his relatives and claim that we shall pay them for common area keeping as well as private gardens. The two guys has a free flat (35 sqm) in the compound area. The constructor claim that since he is still owner of 5 unsold units, he has 5 votes that together with two other turkish owners (his friends)is a majority that can decide on price, what mwen to hire for gardening etc. The two guys are extremely lazy, and work may be one hour a day in summer, and almost nothing in winter season. Questions: Can garden keeping of private property in this compound be decided by a majority ? Can keeping of common property be decided by a majority, even if price/workload seems unreasonable ? What will be a reasonable payment per hour ? In Norway and most other European countries, such work is paid by 35 YTL/hour. We are paying for the described work about 50 YTL/hour + free flat.
