rent increase
What is the percentage a landlord is allowed to increase the rent per year considering that we do not pay in YTL?

Except the specific clauses considering rent increases in the contract of lease which is solely valid for the first extension period , the landlord may ask for the increase of rent for the following terms and only in YTL(Turkishcurrency).
The increase percentage is limited with the wholesale price index (TEFE) up to the amount of %65 for the successing 3 years period of lease; for the following terms the rental is specified by the judge in terms of the equity principle. |

Is it legal to request a rent in usd or eur in turkey? and according to your respond (by the way, thank you for the answer) my landlord want to increase the rent of 43% if you compare in YTL in USD it would be 28% increase for one year.
Another question under which clause would these information be available? (so I could argue with the landlord) Thanks again for your help |

Dear Valou,
Yes it is legal. If you cannot agree upon the increase percentage the landlord may apply for the court and sue you to increase the rent as regards the amounts mentioned in my previous reply. Unless both sides consent to pay in foreign currency, the case to increase rent in foreign currency is not allowed in Turkish law.On the contrary, the judge will convert the rental in YTL and then shall decide in terms of the above said principles.Yet, the rental raised in YTL cannot be below the YTL equivalent of the current foreign currency. |

Any rent increase is stipulated in the contract? (You should check the "special conditions") If not, he is not entitled to ask for a rent increase unless he obtains a judgment in his favour.
