Dear lawyers!
1- What is the relation between "Satis bedeli" on a tapu and the real price that has been paid for the property?

If I buy an apartment which the real cost is 100000YTL how much the "satis bedeli should be?

2- If I sell this apartment after 3 years for 140000YTL how much tax I am obliged to pay to turkish goverment?

Both of them must be same...

Both of them must be same. Never ever accept to declare the sale price at the tapu less than you'd pay to the seller. If you declare it less than the real price, you take the risk of being sued by third party creditors (alleging that the debtor has transferred the property to you to hide his property and not pay his debts, which you would definately lose in that case.) Other kind of actions are also possible but you also take the risk that after a couple of years you'd pay penalty to the tax office for the balance between the real price and the sale price you declared to the land registry. You'd not like to be sued for tax evasion, would you?

Thank you for your answer. Of course I do not want to do anything illegal, and that is why I am asking.

Would you please also answer the last question. It was:

2- Assume that I buy an apartment for 100000YTL. If I sell this apartment after 3 years for 140000YTL how much tax I am obliged to pay to turkish goverment?

I have heard that if I sell an apartment after 5 years I don't have to pay any tax for the profit. Is this true?

If you would sell your apartment before kepping it for 5 years you are going to be responsible with Capital Gains Tax from your profit. According to the government your profit will be the difference between the value of apartment on title deed and your apartment's sales price.

According to your property, if your apartments value on your title deed (TAPU) is 100,000.00.-YTL and if you would like to sell the apartment for 140,000.00.-YTL before keeping it for 5 years; this means you are going to be responsible with Capital Gains Tax from 40,000.00-YTL which means from your profit.

Basically here is the rate schedule for 2008:

The Tax Base Tax
0- 7,800 YTL 15%
7,801-19,800 YTL 20%
19,801-44,700 YTL 27%
44,701- and over 35%
