Varsayılan Turkish Contract Law

I am working on a comparative paper dealing with United States and
Turkish law. I am stuck trying to find the Turkish equivelant of the
American Statute of Frauds. Are there any situations when Turkish
Contracts are required to be in wrighting?

Same problem here: We know the Turkish Law but not the US law. So, to
answer your question we need more details: What's "American Statute of
Frauds" about? What exactly is "wrighting a contract" especially what are
the prerequisites and consequences of this practise according to US law.
If you provide us with more details about these in your law system, it will
give us clues about exactly what you're asking and help us to compare
the systems.

Possibly you have already finished your assignment - but here is at least
one caze where a contract must be WRITTEN: a consumer credit contract
- you can find the relevant articles in Tüketici Korunma Kanunu.

How do you cite that case that you are referring to?

How do I locate it?

You may have already found the answer of your questions, however, I
would like to clarify couple of issues. First of all, we do not have the
Turkish equivalent of the American Statute of Frauds under Turkish Laws,
since judiciary systems are quite different in Turkey and USA. In Turkey,
we have Civil Law system, where codes make the law, whereas in USA,
you have Common Law system, where the legislations are made by the
court precedents. That is why, you may not be able to find exactly what
you are looking for. In general term of fraud is set forth mainly under
Turkish Criminal Law.

Answering your second question; there are some special contracts, which
are required to be written. Those contracts are set forth under Turkish
Code of Obligations. For instance, suretyship contracts will not be binding
and valid unless they are made in writing.

I trust the abovementioned information to be helpfull.

Greetings
I wanted to give additional information to that of those have already been given. As far as ý am concerned The statute of frauds enacted for the purpose of ensuring some specifically cited contracts to be concluded in written form. However in the Turkish law system there is no such law except turkish law of obligations. In the articles of this code, for example the promise of donation contract should be concluded in a written form.Plus ,in specific laws this obligation is laid down(for example leasing law )

Hello

Fraud is forbidden in Turkish Obligations Act Article 28.
But I am not sure how detailed the USA Act you mentioned is. Turkish provision is only 2 paragraphs. Did you mean writing with "wrighting".
If it is so, In Turkey some contracts should be in writing, yes. For example sale of a real estate.
