Recıprocıty Agreement Between Uk And Turkey
I am looking to enforce a UK judgment in the Turkish Court. Is there a reciprocity agreement which will make this possible?

The enforcement and/or recognition of a foreign award or judgement of another country in Turkey is possible.
The process is regulated by the Code of Procedural Private International Law (CPPIL).The one who is seeking a recognition or enforcement should apply for the court of First Instance where the other party is resident or dwells, if not , to the İstanbul , Ankara or İzmir Courts. The process is subject to such conditions: -The Award shall not be in contravention with the Turkish Public Policy -There must be reciprocity between the Turkey and the Country the Judgement was rendered -The judgement ought not breach the mandatory rules of competence binds Turkish jurisdiction -Turkish conflict of Laws must have been applied for the Turkish citizen regarding the cases of personality and the enforcement process were not objected so.There are Turkish Lawyer who registered with law society in the UK.They may help you. |

Although there is no reciprocity agreement/treaty between the UK and Turkey on recognition and/or enforcement of foreign judgments, couple of UK judgments were approved for enforcement in the past. There is a treaty on exemption from security for costs.

One of the conditions applying to the recognition of the foreign court judgements in Turkey, is the reciprocity principle either established by law (or by a mutual agreement) or being this reciprocally practiced (despite no agreements). Although there is not a reciprocity legal tool either a mutual agreement between Turkey and UK, there exists such a practise. Therefore I believe a judgement from UK courts can well be executed in Turkey. At least it's worth trying thus.

if you tell what you mean by saying "to enforce a uk judgement in turkish court" the anwer will be easy.
i mean as proof,as evidence, as a court decission or as withness declaration in the uk case... etc. but in general if it is a valid court sentence it would be implemented in turkish court all the time. for further info you may reach by balkantunali@gmail.com |
