Joint Ownership of Property
I have three fairly straightforward (I hope!) questions regarding joint ownership on turkish property: Firstly, my partner and I (unmarrried)own a 50% share in a Turkish property (currently still under construction). Should either one of us die, would the deceased's 50% share automatically pass to the other shareholder or would it go to Beneficiaries stated in our English will? Neither of us has made a Turkish will. Secondly, could either of us remove the name of the other one without their permission? Thirdly, I assume full title deeds (or tapus) are only issued upon completion of the property and 'handover'? Many thanks

Pursuant To Turkish Civil Act, deceased's property shall inherit to his heirs, unless otherwise specified by a testament.Joint property is not an exception to this rule.
Title deeds may be issued upon registration of your name(s) before the registry.The type of the immovable does not matter.You may have an "arsa tapusu" (land title) regardless of the fact that the building is constructed or not.Since "the ownership of the building is subject to the ownership of land where it dwells" and the shareholders of the land are the same shareholderds of the building. |
