Turkish Appellate Court

The above court issued an injunction on July 11th, 2007 to close the Kisladag gold mine operated by Eldorado Gold, the Kisladag Mine. The court was questioning the Turkish Ministry of Environment about the integrity of the Environmental Assessment Report the ministry issued for this mine.

Can anyone give me a timeline of when this court might deliver it's ruling? The court reconvened on Sept. 5th after summer holidays and the expectation was that it would take 2 months for a ruling to be made.

Any information would be appreciated. Thank you.

As all the procedure laws in the word line up the courts may apply to experts when the case requires any specialists.

Even if the most reliable experts are considered as the state authorities or professors, you -as the side of the case- are always able to object the report of the expert and recommend new experts to court in order to carry out another report on the case.

After receiving the question of integrity of Assessment Report I reckon the judge will be on the verge of making his decision. Probably he is going to ask your comment on the report and reconvene the case for few weeks.

If I were you I would try to get the report as soon as possible and find a better and more qualified expert to asses the report and tell his name to court. The judge will probably wait until the report is received. The point is to be as active as possible in the case and lead the court to the accurate knowledge.

Consequently, after the 5th of September the case will long for one or two more months unless you just tell your objections.
