Divorce procedure

I am wondering what the procedure is if two foreign nationals who got married in Turkey but live in their home country wish to get a divorce? Is it sufficient for them to get married in their home country or would they need to notify the authorities in Turkey as well?

Two foreign nationals married in Turkey may divorce in abroad. However, legalization of the divorce between the two before the Turkish Authorities requires the enforcement of the Court's decision in a Turkish Court.

Would it be possible for a Power of attorney to be given to a Turkish lawyer to file for a divorce. If the divorce is NOT granted I would only have to wait 3 years of not cohabitating with the wife to get a divorse then? Is this true?

Yes, it is possible.In case the case is filed by your initiative on any ground and the divorce decision is not granted, then after the completion of a three years period in which the spouses have not cohabited as husband and wife, the law takes for granted that the marriage is irretrievably broken.On that occasion, the judge should decree divorce on the request of each one of sides.

These above said are the stipulations of Turkish Law; Take into account that if both sides are foreigners the Turkish Conflict of Laws refer to the law of their joint nationality.( if it is not then the law of the common place of their residence)
