ACTUS REUS ( PHRASE) : Latin Phrase for the 'guilty act' which must be proved in a criminal case . Each crime must be looked at individually to see what must be proved to establish its actus reus. The actus reus may be an act or it may be a failure to act. For some crimes , it may also be necessary to show that a particular consequence has happened or that a certain state of affairs exists.
